New Delhi: The National Consumer Disputes Redressal Commission (NCDRC) has ordered Today Homes & Infrastructure to return Rs 18.29 crore to 30 homebuyers for not being able to give possession of their properties on time. The realty firm has also been asked to pay interest and litigation cost on top of the Rs 18.29 crore amount. The litigation cost fixed by the court is Rs 25,000 for each of the homebuyer.
The homebuyers had approached NCDRC saying they have not received possession of the flats in the ‘Canary Greens’ project in Sector 73, Gurgaon even after considerable delay, according to media reports.
NCDRC asked to realty form to pay 12 percent interest on the amount collected from each of these 30 homebuyers. The court took note of the fact that these homebuyers had taken home loans and were paying an interest of 10.25-12 percent on that.
The allotments of properties to these 30 buyers were made on different dates between 2011 and 2012 and the possession was to be given to them within 36 months of allotment, with a grace period of six months.
