New Delhi: With Delhi assembly elections close by, the central government has legalized 1797 unauthorized colonies in Delhi which will make it possible for development/redevelopment to take place in these colonies and will benefit anout 40 lakh people living in these colonies.
The Union cabinet too this decision and Minister for Housing and Urban Affairs Hardeep Singh Puri said that a bill will be introduced in the Winter Session of Parliament to formalize this decision.
The bill will enable recognizing Will, General Power of Attorney (GPA), Purchase documents, Possession Documents, Agreement to Sell by the residents of these colonies. The bill will also provide for registration charge and stamp duty on last transaction and also address the issue of income tax liability on account of less than circle rate charges.
The Delhi Development Authority (DDA) will be tasked to lay down the procedure for issuing conveyance deed and registration of property. The boundaries of the these colonies will clearly marked by DDA.
The government has also decided not to levy penalty and external development charges (EDC).
The ownership rights of the property will be conferred on the residents on payment of charges based on carpet area or plot size. For colonies on government land, the charge will be 0.5 percent (for less than 100 sq m), 1 percent (for 100 – 250 sqm) and 2.5 percent (for greater than 250 sq metres), of the circle rate of highest category of locality of the residential area surrounding these colonies. For colonies on private land, the charge will be half of the charge on government land.
